1. Terms of use
Welcome to LMCHING.COM, the leading on-line one-stop shop for all your cosmetics, skincare, fragrances, haircare and other personal care needs. To ensure a safe, enjoyable environment for all of our users, we have established our Terms of Use. They spell out what you can expect from us and what we expect from you. Please note that by accessing any area of LMCHING.COM, you agree to be bound and to abide by these Terms of Use. We also strongly advise you to see our full privacy policy statement.
LMCHING.COM is owned and operated by LMCHING Group Limited. Any reference in these Terms of Use to lmching.com shall include reference to LMCHING Group Limited and their respective employees and agents.
2. Compliance with laws
LMCHING Group Limited is a company incorporated under the laws of Hong Kong. We operate in Hong Kong and comply with all the laws and regulations of Hong Kong. All our products are in compliance with all the requirements and specifications under the laws of Hong Kong. We are not in a position to guarantee compliance with specific local requirements or specifications under the local jurisdictions of customers.
Our products and shipment fees are denominated in HKD dollars with local currencies equivalent for reference. All orders placed are transacted in HKD dollars.
3. Order Terms and Use of Discount Codes/Vouchers
Our order terms are contained in the FAQ page. All orders are subject to these order terms in addition to these Terms of Use.
Customers must apply any discount codes or vouchers at the checkout page before completing the payment process. We will not accommodate the inclusion of discount codes retroactively nor issue refunds for the discount amount if a discount code or voucher is not applied before payment. It is the customer’s responsibility to ensure that all discounts are applied prior to finalizing the transaction.
4. Our trademarks, service marks & copyright
The following trademarks and service marks belong to LMCHING Group Limited or its affiliates and all rights in them are reserved: LMCHING, LMCHING Group, LMCHING Group Limited, LMCHING.COM.
These and other LMCHING or LMCHING.COM graphics, logos, service marks and trademarks of LMCHING Group Limited and its affiliates and subsidiaries may not be used without the prior written consent of LMCHING Group Limited or its affiliates or subsidiaries.
All other trademarks, product names, company names and logos appearing on LMCHING.COM are the property of their respective owners. All content on our site, including design, text, graphics, logos, button icons, images, software and audio clips; any improvements or modifications to such content; any derivative works thereof; the collection, arrangement and assembly of all content appearing on LMCHING.COM, are the exclusive property of LMCHING.COM and are protected by Hong Kong and international copyright and other applicable intellectual property laws.
All software used on our site is the property of LMCHING.COM or its software suppliers and is protected by Hong Kong and international copyright and other applicable intellectual property laws.
5. Use of Site
This site may currently only be used as a shopping resource or to conduct online communications. You may not post or transmit any material which is objectionable (whether harmful, threatening or otherwise); LMCHING.COM reserves the right (but without the obligation or liability) to prohibit or remove any such material.
6. Title of Products, Documents and Fees to Import
All title of products will be passed to customer when order is dispatched LMCHING.COM. LMCHING.COM will deliver the products according to customer’s instructions.
For many international shipments you may be required to pay customs and duties, obtain certain licence or apply for registration of your purchased products in your own country to receive delivery of your package. The customs charge and/ or import regulation is determined completely by the government of your country, and as such we have no control over those costs or regulations.
As such, LMCHING.COM will not pay, nor be held responsible, for such costs or arrange for application of import license. By continuing with you order you agree to be responsible for any customs or duties incurred as a result of your country's customs and duties regulations as well as obtaining any import registrations or license required for the products you are purchasing. If the package is rejected by the customs of your home country or otherwise and returned to LMCHING.COM you will be responsible for the return shipping charges.
7. Disclaimer
The site and its content are provided on an "as is" basis without warranties of any kind, whether express or implied (except only as may be implied by applicable law). LMCHING.COM is only providing a venue for the sale of products on its site and shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages (including damages for loss of profit or intangible loss related to your use of the site or use of any of the products purchased at its site).
Please read all information, warranties or warnings provided by the manufacturer owner or seller of the products on or in the product packaging and labels before using any product purchased on LMCHING.COM.
LMCHING.COM shall not be liable for the accuracy, fitness for a particular purpose or quality of such products or reliability of any information provided by any manufacturer owner or seller of such products and it is your responsibility to evaluate such information.
Although LMCHING.COM uses reasonable efforts to have the colors of the images of its merchandize displayed as accurately as possible on the site, we do not warrant that the color will be accurately displayed by your monitor.
8. Indemnity and Limitation of Liability
You agree to indemnify, defend and hold harmless LMCHING.COM from and against all losses, expenses, damages and costs (including reasonable legal fees) arising from any breach of these Terms of Use or any other activity by you in connection with your use of the site.
You further agree that LMCHING.COM shall not be held liable howsoever for your use of the site and you agree to waive all claims that you may have against LMCHING.COM for any loss or damages you may sustain in connection with your use of the site. In the event that this disclaimer is unenforceable, the total liability of LMCHING.COM, if any, for losses or damages shall not exceed the fees you paid for the particular service or product upon which liability is based.
9. User submitted content and comments
We invite you to discuss issues and share your views. We encourage robust debate and criticism provided it is civil. But our comment section is a moderated online discussion, not a public forum.
We reserve the right to reject comments, images or links that:
▪ are offensive or obscene;
▪ contain objectionable or profane language - including use of symbols (we maintain a list of banned obscenities and comments featuring those words will be automatically rejected);
▪ include personal attacks of any kind (including name-calling; insults; mocking the subjects of stories or other readers; or abusing LMCHING journalists or contributors);
▪ are discriminatory or express prejudice on the basis of race, ethnicity, country of origin, gender, sexuality, religion, or disability;
▪ constitute harassment, including but not limited to sexual harassment;
▪ are body-shaming;
▪ contain spam or include links to other sites; ▪ are clearly off topic, including queries or comments about moderation;
▪ are deliberate lies, misinformation or attempts to mislead. While we cannot review all comments for accuracy, we reserve the right to reject comments we consider, on the balance of probabilities, to be deliberate falsehoods or unsubstantiated rumours;
▪ impersonate an individual or organisation, are fraudulent, defamatory of any person, threatening or invasive of another's privacy or otherwise illegal;
▪ are trolling or threatening;
▪ advocate or endorse violence, vigilantism or law breaking;
▪ infringe on copyrights or trademarks;

▪ violate the law or breach court-ordered suppressions or have the potential to breach future suppressions; or

We retain the right and discretion (but not the obligation) to edit, delete, reject or remove any comment which you post or seek to post in the comments or LMCHING Review areas.
You agree to fully indemnify and hold us (and our related entities) harmless against any liabilities, claims, costs, loss (including consequential loss) or damage incurred as a result of any material you post in the comments areas, or as a result of any breach by you of these terms and conditions.
Notwithstanding any indemnity provided by you under these terms and conditions, we and/or our related entities retain the right to assume the conduct of any defence to a claim brought against us, and of any proceeding or appeal issued by us, and you agree to provide all reasonable cooperation (including by making available relevant documents) that we may require from you in relation to any such claim, proceeding or appeal.

Occasionally, LMCHING.COM may make available a link to a third party's web site. These links will let you leave LMCHING.COM. The linked sites are not under LMCHING.COM control and LMCHING.COM is not responsible for the contents of any linked site or any link contained in a linked site, or any changes or updates to such sites.
LMCHING.COM is not responsible for webcasting or any other form of transmission received from any linked site. LMCHING.COM provides the links only as a convenience. LMCHING.COM does not endorse the site or its use or contents.

12. Termination
LMCHING.COM may terminate or suspend your access to all or part of the site, without notice, for any conduct that LMCHING.COM, in its sole discretion, believes is in violation of any applicable law or is harmful to LMCHING.COM or a third party.

You irrevocably agree that the courts of Hong Kong Special Administrative Region shall have exclusive jurisdiction in relation to any claim or dispute concerning or arising from these Terms of Use.
